We think that local authorities should be under a duty to have a presumption towards Education Other Than At School (EOTAS) named in an EHC plan where the circumstances outlined below apply.

- The required provision from EHCP section B can be met outside a school setting: - The child's background and medical history support EOTAS; and, - There is a clear parental preference for EOTAS We think alternative provision is too hard to justify on an EHCP. We think this is wrong and should be changed. School can be a cause of trauma for some kids, leading to emotional distress, school refusal, and a vicious circle of mental health problems that make it harder and harder to get an education. We think children with neurodivergent traits, are disproportionally affected.
