We feel that the common law offence of Misconduct in a Public Office is outdated and there isn't clear enough guidelines about how this offence is committed.
We think that if the government creates this legislation, it will provide a clear and concise description of what Misconduct in a Public Office is and will also assist the courts with sentencing. At present, we feel there is no clear definition of Misconduct in a Public Office and no clear sentencing guidelines.
