The Government should review section 91(14) of the Children Act 1989. Consider stricter criteria of when barring orders under the section can be used. We think these orders could affect a child’s wellbeing and the voice of the child and parent.
We think when safeguarding concerns are raised, the order should cease immediately. We believe any judge considering making such orders should be required to have a fact-finding hearing as a standard first.
