We believe delay on legal reform risks the same failings seen in the ECHR’s Swiss climate ruling. Nine democracies have published a statement supporting ECHR interpretive reform. We think the UK should act now to protect national law from judicial overreach and ensure democratic accountability.
We think the ECHR’s Swiss climate ruling showed that governments can violate rights by delaying action on foreseeable risks. We think that if the UK ignores allies’ calls for ECHR reform, it risks ceding democratic legal control. Our view is that signing the joint statement now ensures clarity before judicial overreach becomes entrenched.
