Establish an independent statutory dedicated SEND regulator with powers to monitor, investigate and enforce Local Authorities’ compliance with their legal duties towards children and young people with SEND.
In our view too many children with SEND only receive the education and support they are legally entitled to after their families pursue complaints, mediation or Tribunal appeals. We think children should not have to rely on whether their parents have the time, money, confidence or legal knowledge to secure the education and support they are already legally entitled to. We therefore believe that an independent dedicated SEND regulator could better oversee Local Authorities’ compliance with SEND law and address systemic failures.
