We urgently call on the Government to amend the Employment Rights Act to ensure that the proposed bans on restrictive NDAs and non-derogatory clauses apply retrospectively.

We demand amendments to the Employment Rights Act to make the NDA ban retrospective. We believe the 2027 draft leaves past victims permanently silenced under threat of legal penalties, letting predatory employers hide historic wrongdoing. We demand: Retrospective Effect: Void all historic clauses silencing disclosures of workplace abuse and harassment. Victim Amnesty: Grant legal immunity to individuals speaking out about past abuse.
