Review the current legal framework governing Ofcom’s enforcement of the Broadcasting Code, to investigate whether it remains fit for purpose. The review should look into legislating to strengthen the regulatory framework, improve accountability and maintain public confidence, if deemed necessary.

Ofcom has significant enforcement powers, but some broadcasters have been found by Ofcom to be in breach of the Broadcasting Code on multiple occasions. We believe the Government should review whether the current legal framework provides sufficient deterrence against repeated serious breaches, and whether legislative reform is needed to ensure the framework remains effective, proportionate and able to maintain public confidence in the regulation of UK broadcasting.
